Terms of Service

These Terms of Service ("Terms") govern your use of the email hosting services provided by 3Z Mail Services Ltd ("3Z Mail", "we", "us", or "our"), accessible through the domain 3z.nz and associated subdomains. By creating an account or using the service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 16 years of age to use the service. By creating an account, you represent that you meet this requirement. 3Z Mail reserves the right to suspend or terminate accounts that do not comply.

2. Account registration

3Z Mail currently operates on an invitation-only basis. Account creation requires an invitation from an existing authorised user or from 3Z Mail directly. We reserve the right to refuse service to anyone for any lawful reason.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.

3. Acceptable use

You agree not to use the service for any unlawful purpose or in violation of these Terms. Prohibited activities include, but are not limited to:

• Sending unsolicited bulk email (spam) or engaging in phishing
• Distributing malware, viruses, or other harmful code
• Using the service to harass, threaten, or defraud others
• Attempting to gain unauthorised access to our systems or other users' accounts
• Using the service in a manner that materially degrades performance for other users
• Violating the intellectual property rights of others

We reserve the right to suspend or terminate accounts that engage in prohibited activities, with or without notice, at our sole discretion.

4. Service availability

We strive to maintain high availability but do not guarantee uninterrupted access to the service. We may perform scheduled maintenance from time to time and will endeavour to provide advance notice to account holders when practical.

3Z Mail is a small-scale service. We do not offer a service-level agreement (SLA) guaranteeing specific uptime percentages. If continuous availability is critical to your use case, this service may not be suitable for you.

5. Fees and billing

Service fees, if applicable, are communicated at the time of account setup. Fees are billed in advance on a monthly or annual basis, as agreed. Failure to pay fees when due may result in suspension of the account. Account data is retained for 30 days following suspension, after which it may be permanently deleted.

All fees are stated in New Zealand Dollars (NZD) and include GST where applicable.

6. Intellectual property

3Z Mail retains all rights, title, and interest in the service, including its software, branding, and documentation. You retain all rights to the content you store and transmit through the service. We claim no ownership over your email content.

7. Limitation of liability

To the maximum extent permitted by New Zealand law, 3Z Mail Services Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the service. Our total liability for any claim arising from these Terms or the service shall not exceed the amount you have paid us in the 12 months preceding the claim.

We are not responsible for the content of emails sent or received through the service, nor for any loss or corruption of data, except where caused by our gross negligence or wilful misconduct.

8. Indemnification

You agree to indemnify and hold harmless 3Z Mail Services Ltd from any claims, damages, or expenses arising from your use of the service in violation of these Terms or applicable law.

9. Termination

You may close your account at any time by contacting us. Upon account closure, your email content will be permanently deleted within 30 days. We may terminate or suspend your account at any time for breach of these Terms, with notice where practical.

10. Changes to these Terms

We may update these Terms from time to time. Account holders will be notified of material changes by email at least 30 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
